2. Services
Trout Brook Arborists provides professional tree care services throughout Connecticut, including but not limited to: tree risk assessment, emergency removal, tree planting and lawn installation, tree removal, tree and shrub care, and stump grinding.
All services are subject to a separate written estimate or service agreement provided at the time of scheduling. Estimates are valid for 30 days from the date of issue unless otherwise stated. Final pricing may vary based on site conditions discovered during service delivery.
3. Service Agreements and Scheduling
Scheduling of services is confirmed only upon written or verbal acceptance of a formal estimate. We reserve the right to reschedule services due to weather conditions, equipment availability, or other circumstances beyond our control. We will provide reasonable advance notice of any scheduling changes.
Customers are responsible for ensuring clear access to the work site, notifying us of any underground utilities, irrigation systems, or other hazards prior to service, and obtaining any required permits or HOA approvals before work begins.
4. Payment Terms
Payment is due upon completion of services unless otherwise agreed in writing. We accept cash, check, and major credit cards. A deposit may be required for large projects. Invoices not paid within 30 days of the due date are subject to a late fee of 1.5% per month on the outstanding balance.
In the event that collection action is required, the customer agrees to pay all reasonable costs of collection, including attorney's fees.
5. SMS and Text Message Communications
By providing your phone number and submitting a service inquiry, you consent to receive text messages from Trout Brook Arborists related to your service request, appointment scheduling, and follow-up communications. Standard message and data rates may apply.
How to Opt Out — Reply STOP
You may opt out of receiving text messages from Trout Brook Arborists at any time by replying STOP to any text message you receive from us. After sending STOP, you will receive a single confirmation message and no further text messages will be sent to your number. To resume receiving messages, reply START.

Message Frequency
Message frequency varies based on your service inquiry and scheduling activity. You will not receive unsolicited promotional text messages. All messages are directly related to your service request or scheduled appointment.
6. Liability and Property Damage
Trout Brook Arborists carries general liability insurance and workers' compensation coverage. We will exercise reasonable care in performing all services. However, we are not liable for pre-existing conditions, hidden defects, or damage to underground utilities, irrigation systems, or structures not disclosed prior to service.
Any claims for property damage must be submitted in writing within 7 days of service completion. We will investigate all claims promptly and in good faith.
7. Limitation of Liability
To the fullest extent permitted by applicable law, Trout Brook Arborists' total liability for any claim arising from services rendered or use of this Website shall not exceed the amount paid by the customer for the specific service giving rise to the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages.
8. Website Use
You agree to use this Website only for lawful purposes and in a manner that does not infringe the rights of others. You may not use the Website to transmit any harmful, offensive, or disruptive content, or to attempt to gain unauthorized access to any portion of the Website or its related systems. Cancellations made with less than 48 hours' notice may be subject to a cancellation fee equal to 15% of the estimated service cost. Emergency services are non-cancellable once crews have been dispatched.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Connecticut, without regard to its conflict of law provisions. Any disputes arising under these Terms shall first be addressed through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Hartford County, Connecticut, in accordance with the rules of the American Arbitration Association.
